In short
- We respect creators' rights and respond to valid copyright notices.
- Send notices to our designated agent below. We remove infringing material and tell the site owner.
- Site owners can send a counter notice if they believe material was removed by mistake.
StitchWeb.Design LLC hosts websites for small businesses. We respect intellectual property rights and expect our customers to do the same. We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
How do I report copyright infringement?
Send a written notice to our designated agent that includes:
- Your physical or electronic signature.
- A description of the copyrighted work you believe is infringed.
- The address (URL) of the material on a site we host, with enough detail for us to find it.
- Your name, mailing address, phone number and email.
- A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.
Who is our designated agent?
- Name: Copyright Agent, StitchWeb.Design LLC
- Address: 9846 Highland Crk, San Antonio, TX 78245
- Email: hello@stitchweb.design
What happens after a notice?
We review every notice. When a notice is valid, we remove or disable access to the material, notify the site owner and give them a copy of the notice.
How do I send a counter notice?
If material on your site was removed and you believe that was a mistake or a misidentification, you can send our agent a counter notice that includes:
- Your physical or electronic signature.
- A description of the material that was removed and where it appeared before removal.
- A statement under penalty of perjury that you believe in good faith the material was removed by mistake or misidentification.
- Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice.
We send the counter notice to the person who sent the original notice. Unless they tell us within 10 to 14 business days that they have filed a court action, we may restore the material.
What about repeat infringers?
In appropriate circumstances, we end the service of customers who repeatedly infringe the rights of others.
What about trademark and other complaints?
If you believe a site we host misuses your trademark or business name, email us with the details and we will look into it. If a concept design we made shows your business and you would like it removed, see our Concept Designs Notice.
A note on false claims
Under the DMCA, anyone who knowingly makes a material misrepresentation in a notice or counter notice may be liable for damages.
